Merrily we go to Hell is based on the play "I Jerry take thee, Joan" by Cleo Lucas.
The cheat violated the Production Code's strictures against miscengenation, sadism, white slavery and rape. Merrily we go to Hell violated the Production Codes strictures against scenes of drunken parties, clinging Travis Banton gowns and Art Deco settings.

In 1934, Hollywood was turned upside down by the enforcement of a strict "Production Code" that would change the way movies were made for the next 34 years. But during the "pre-Code" period (1929-1934), censorship barely existed and filmmakers had free reign to make the movies they wanted and the public demanded. No subject was taboo including adultery, murder or sex.
The cheat: A spoiled socialite is a gambling addict. She borrows money from an exotic art collector in order to replace what she has stolen from a charity. The collateral for the loan may be a shock, a there is a large penalty for default. A catalog of selfishness, desire and revenge, not to mention a touch of kinky.
Merrily we go to Hell: Jerry Corbett finally meets and marries Joan Prentiss, the right girl. Unfortunately their wedded bliss is interrupted when Jerry's play becomes a hit and he hooks up with the wrong woman from his past. Joan decides that turn-about is fair play and she picks Charlie to escort her to various parties around New York. Eventually Jerry quits drinking and sends his girlfriend packing, just in time for Joan to take him back.
